The Importance of Constitutionalism
The power of the government is limited by a constitution. Hence constitutionalism. Is it essential through constitutionalism that there be a constitution? Well I think it's that governments are limited by law. The form that those limits take we can have an argument about. It might be that those limits are in a document that has a heading at the top that says capital T, capital C, the constitution. But it might be thatthose limits are elsewhere,. That those limits are judicial decisions, in legislation, in constitutional conventions, as well.
