When i was united states attorney, if a defendant waived the right to trial by jury, and they thought that the judge would be more sympathetic to the case and might be more likely to acquit, we would none the less agree to allow that trial to go before the court to be a bench trial. I think there's too much at stake. And people can make arguments about the jury pool, but depending on who appointed the judge, i think it's too much responsibility for that. But the good news is we don't have to think about that and worry about that for a long time. This question comes in a tweet from our friend walter show actualy. As he says,
