When you go into court and get a search warrant, the premises that you're collecting information to investigate criminal activity are not your home. The government's authority to get a warrant is not just to obtain new evidence to investigate crime. In this case, what the Department of Justice did was essentially they seized the malware that was being used by the half-mium hackers.
