The Future of Affirmative Action
If I'm looking to cast an actor in the lead role, I would be deliberately discriminating against non-whites. How does that square with the law? So if you have a legitimate business reason that works, that's going to fly. When I stop finding cases where women are paid less for equal work than their simply situated comparators, that's when I'd stop bringing gender discrimination cases.
