The Fifth Circuit's Order to Overrule Miffa-Pristone
The Fifth Circuit has kind of rolled back the revisions that the FDA made in 2016 and 2021 to access to Miffa-Pristone. The court concluded, at least on an interim basis, that the FDA's decision to do that was arbitrary and capricious. And we have a sort of breadcrumb trail from the Fifth Circuit suggesting that in more ways than one, things could get much worse down the road.
