The Fifth Circuit's Dismissal of Church-State Claims

Pastor Mark Anthony Spell and his church appealed the dismissal of their 42 USC Section 1983 claims. They alleged that state officials violated their rights under the religion clauses of the First Amendment. The Fifth Circuit was very annoyed with this. There is no government authority over the church.
