Is There a Billion Dollar Clause?
There never was an f off for a billion dollars clause. For anybody, it's correct. But the significance is, if you were trying to argue that there's just no way to calculate damages here, and therefore it must be irreparable harm,. A really good counter argument is, well, th the parties kind of agreed to liquidate a damage - can you say that this isn't a fair measure of damages? And i think, i think, you put those two things together, and again, i want to be clear, it would not be impossible.
