The Importance of Moral Opinions in Contracts
The Henningson versus Bloomfield Motors. 1960. The court said you can't enforce that, but there was no law in place to do so. So Dworkin is claiming that it looks like they just applied their intuitive moral sense of what's not fair. He wants to distinguish between the rules that have been passed and those established by judicial precedent.
