The DOT took the perhaps disingenuous view that Southwest was just countering the fact that other carriers were charging a separate bag fee. They also wrote that they did not feel a reasonable consumer would think that without buying a ticket, the carrier would transport their luggage for free. The reasonable consumer standard is interesting, especially when you're talking about disclosure of all the fees and what might look like on your phone.
