The Role of Speech Restrictions in the Canadian Constitution
The Supreme Court of Canada explicitly assesses the value of targeted expression. If it's speech that doesn't advance search for truth, participation in democracy and individual self-fulfillment, then the court will let the government restrict it. I don't have a problem with those three values are important reasons to protect freedom of expression. But when you look at the actual case law, the court's treatment of those values is just unpersuasive, right? So like I kind of get into how the court addresses these values to hate speech.
