The Major Questions Doctrine
There's an argument that that these new regs go far beyond the statute in terms of sexual harassment free speech due process and all those other things. Mr. Farber will talk more about the major questions doctrine but suffice it to say, I think there's not only no clear statements from Congress here. The presidency must be able to point from a clear statement from Congress to justify its rulemaking. There certainly is noclear statement from Congress here that the purpose of Title nine was to allow Leah Thomas to compete on the women's team at the University of Pennsylvania or anybody likely at Thomas.
