The Constitution and the Concept of Standing
Joseph Story writes a letter to a friend afterwards, saying, you know, take a look at this opinion that I wrote for the court in Martin versus Hunter's Lessie, John Marshall concurred in every word of it. So yes, he's not sitting on the bench, but he's litigating the case and apparently talking about it in the boarding house with the justices. But legal ethics rules have changed over the years and we'll talk about that in a future episode.
