The court also ruled in favor of the plaintiffs on their vagueness claim, finding that the concepts in the act were unconstitutionally vague. Judge Walker did not buy our argument that at least if the court wasn't going to find that this is not, the first amendment is not implicated. In the court's view, the act was a viewpoint restriction and so strict scrutiny should apply. Finally, the court concluded that the act could not satisfy strict scrutiny.
