Is It the Courts' Job to Decide on Climate Change Policy?
The ergenda case does not a legal precedent for a case being brought in germany, but it might inspire lawyers across several borders to try a similar approach. Judges and lawyers all around the world are saying that they're watching courts in other countries in order to understand how it's unfolded elsewhere. There's a strong, i think, argument that regulating omissions is a matter for governments and not for judges. The courts are there to decide how the laws are meant to be interpreted.
