I Think It's an Institutional Design Problem
The law is shaped by random private person who just happened to be the one whos in whose case thirit was granted, and the government. So why do we think this ran em you know, defendant and their lawyer or better position to kind of shape the law? I don't think it's inevitable. It's a democracy problem. Partly. You could call democracy just an institutional asign problem. But why is it a democracy? Pr, because there's often private party.
