Consent - Is There a Reasonable Body of Obsetricians?
The trust won, as you know, because there was a body of obsetricians in scotland who would have done exactly the same. So what the supreme court did is to say essentially that it is not sufficient to say there is a reasonable body of obsetrician for consent. That has to be a logical and sustainable analysis or approach, as judged by lawyers. And i think that montgomery simply applies that same qualification context of consent on this case.
