The New Mechanism for Departing From Retained You Law
The bill contains a new mechanism for working out how and when to depart from retained you law. It's difficult to say what the effect of this will be, but it would allow courts to depart from case law. This is a power that is rarely used by the Supreme Court because judgments are declaratory nature they don't act prospectively.
