What's the Purpose of the Illinois Act?
The Illinois Act was enacted in 2008, technically it was the second state biometrics law after Texas. The idea was to make sure that people were notified and give their consent for those collections. But the intention wasn't what we have in place now, which is a hot bit of litigation with absolutely enormous potential damages when plaintiffs don't have to show any actual damages at all.
