Comet 2 has been open source since it was released in 2011. The game is now owned by a museum of modern art, which means the code can't be used for anything other than to store sales data. But that doesn't mean there's no risk when you're releasing an entire version at once. It could lead to legal problems if people don't get their hands on all the files before they're published.
