In each of these cases, the court had a Republican majority. Lewis Powell was the key vote in the Baki case. Sandra Day O'Connor was the keyVote when the Fisher cases came up. The arguments raised against affirmative action are the same arguments that were raised in 1978 and in Baki. And most of the arguments defending affirmativeaction are the same ones that were raise in Baki or Gruder.
