The Process of a Criminal Case and the Fourth Amendment

Terry v. Ohio was argued in December 1967 and the court handed down its decision in June 1968. In this case, Martin Luther King has been murdered and so has Robert Kennedy actually just days before this opinion comes down. The criminal defendant can challenge the evidence that was collected against them or they can challenge the entire arrest if the police violated the person's Fourth Amendment rights somehow.
