The Dangers of Strict Scrutiny in the Wake of the Korematsu Case
In the immediate aftermath, you know, when there's a demonstrable tie and I think a proximity to that action, then of course that we can institute remedial measures. The other instance would be national security or another example that comes up is let's say in a prison, a prison riot where there are prison gangs that have self segregated based on race. But those are really the only two instances. And even with instances of national security, I think the Korematsu case shows how dangerous this can be, right? Because the government was claiming that it needed to do things in the name of national security.
