Is It a Good Idea to Let Justices Choose Their Own Retirements?
I think almost nobody thinks that it's good policy to let people on the US Supreme Court choose their own retirements. There are excellent arguments for term limits and law professors debate this, but I think it probably requires a constitutional amendment. If the court were to adopt the most expansive version of the independent state legislature theory, that would be a radical change in how American elections are conducted. Can we talk about some current issues and topics at the court and get your thoughts and maybe even get you to predict some things?
