The Basic Fairness Issue in Tort Law

The question is how much risk should people who aren't participating in a given activity be exposed to from that activity. I think that gets into a basic fairness issue here, which you see in many areas of law. So for example, if you're jogging in a park that has a baseball diamond, there's some risk that you'll accidentally get hit by a fly ball. In fact, you can't shoot guns at a neighborhood park.
