Is the Supreme Court Going to Defer to Legislators?

If the Supreme Court is going to defend something as a right, it has to be because it's a right. Unless those social effects implicate the violation of a right, the court may have to defer to the legislature on them. And that in part goes straight to the heart of the primary opinions argument regarding the use of history and the use of historical context.
