Isn't an Israeli BDS a National Origin Discrimination?
Arkansas had placed some responsibilities on state contractors, for example, that they couldn't participate in an economic boycott of Israel. But the 8th Circuit said if we're talking about specifically commercial activity, rather than preventing someone from speaking against Israel, then we are going to uphold the law. The question then becomes to what extent is economic activity expression? And there's a lot of circumstances where economic activity is actually expression.
