Will the Biden Administration's Rule Be Struck Down?
Josh Lichtenstein: It's hard to predict how this particular court and how the fifth circuit also on appeal will react to these types of arguments. He says it would be very unfortunate for pretty much every stakeholder if the rule was struck down because I really do believe that the Biden administration rule gets it right in a way that administrations, both Democratic and Republican, have failed to do so in the past. The ultimate outcome might be a reversion to the prior law," Lichtenstein adds.
