The Problem With Popper's Theory

Popper's theory initially seems to have been aimed at the idea that you could refute a theory just by having an observation alone. But if you actually understand Popper's theory of refutation as being a refutation of the combination of the theory plus background knowledge, then normal science is a kind of refutation and it's not actually any more. So this would be an example of how Popper actually refuted his own theory through example and then replaced it with something better. Do you see where I'm going with this? Popper's Theory is not clearly in the metaphysical realm. And in fact has counter examples and in fact may count as a scientific theory too.
