The Supreme Court's Decision to Overrule Australian Constitutional Amendments
The chances of the court overruling this legislation are quite slim. The high court or Supreme Court is very unlikely to declare this constitutional change to be unconstitutional. If that was to happen, the country would have a constitutional crisis because then the government could respond by not listening. There are some suggestions in the Israel request that this is exactly where the government is heading to. And they instigated this amendment in an attempt to generate this constitutional crisis which will then enable them to move forward with the rest of the judicial reform quicker.
