Courts are now considering the consumer perspective and looking at dark patterns and how services are presented to users in consumer privacy claims. Additionally, courts recognize the value of collected data and its potential to reveal information about individuals' internet usage. Privacy policies may no longer be sufficient, and pop-up notices are suggested to inform users about data collection and give them a choice.
