The Untested Legal Theory of Defense in the Case of General Milley
In theory of defense, they believe that under the Presidential Records Act, he had the exclusive right to determine which documents were personal and which were presidential. So in order to then go and say, well, they're personal now, that would also have to be proven in court. This is not sort of something that will just be accepted by a judge because it just has not been tested. It's made more difficult as former Attorney General Bill Barr has pointed out that these are documents that were created by the government and also classified.
