The idea of rights that you don't get in virtue of your humanity, but from being a citizen is much older as far as I can tell. In Rome, laws gave certain entitlements to citizens because they were Romans and they had citizenship. And we still have all kinds of rights that are of that kind. But the biggies for a very long time were appeals to God and then appeals to nature.
