The New Admissions Criteria Are Race Neutral
Under the old policy, a prospective student must reside in one of five participating school districts and be enrolled in eighth grade. Now important evaluators are not told the race, efnicityg or even names of the applicants before them. So it is race neutral in that sense. Half of the applicants self identified as asian. Under the new policy, 54 % of the offers went to as students. However, 65 to 70 per cent of the offerswent to agent students. And judge hitton's point is that means there's no disperate impact. If you are over represented from the applicant pool, you can't have a disperate impact claim.
