The Role of the Federal Courts in the Reversed Constitution
Liberal commentators are not happy that the court has left open the door to federal intervention. But I am highly, highly skeptical that if the composition of the federal courts were reversed, those same commentators would demand some degree of at least the possibility of federal judicial intervention. My sense is that it will be interpreted more along the hey, federal courts, you know, if you really feel like you need to, maybe there's an avenue here.
