How Specific Does Your Litigation Have to Be?
This case allows your lack of access to result in your case getting tossed out, because you're not allowed to get to the stage of litigation where you can actually get evidence and find out what happens. The legal system is supposed to be a way for us to ddress wrong doing among private parties. So why should the courts stand in the way of that? This case has allowed courts to essentially draw conclusions before any evidence is presented.
