Do You Know if Using Copyright Protected Works to Train an AI Platform Is Fair Use?

The Fair Use Doctrine permits the use of copyright protected work in certain contexts to promote freedom of expression and for other specific purposes. It may be the case that using copyright protected works to train a platform would constitute fair use, but using it to generate new content may not be. For example, if millions of photos were provided to an image generating platform and it generated a novel image, it seems unlikely that would constitute copyright infringement. On the other hand, if the platform had only a small sample of photos to work from and if perhaps those photos were from the same creator, the resulting product could constitute copyright infringment.
