I don't see this as caving in. I remember having to deal with that when I submitted the option to Apple to be put on the iOS store, things like that. It's up to the copyright holders of whatever property is an issue to say, hey, this is a problem. Can we take it down, please? That's going to stand it across no matter where you have published games or apps. Inferno says it seems like bad precedent to set buying a Nintendo to cave in.
