The Lincoln Administration Suspends the Writ of Habeas Corpus
In 1861, President Lincoln suspends the writ of habeas corpus in Maryland. The Constitution allows for such a suspension when public safety is at risk. Supreme Court Chief Justice Roger B. Tommy says it's unconstitutional because Congress has power to do so. John Avlon: It doesn't mean everyone stops worrying about the potential precedence being set.
