El Paso is under a state of emergency because city officials say they don't have enough resources to handle this. With Title 42 out, the new law of the land is actually the old one, Title 8. It includes criminal penalties for crossing illegally and re-entering the country illegally. All this boils down to the devil being in the details in border patrol sectors that have limited resources.
