The Inherent Traits of Intellectual Disability
Intellectual disability is a developmental disorder. It creates limitations in intellectual functioning and adaptive behavior. International human rights law says that persons with intellectual disabilities should not be given the death sentence. In India, even though we have a high percentage on their tro there is absolutely no conversation on how will indian death penalty jurisprudence deal with questions of intellectual disabilities? Never been brought to the notice of court. You don't go searching for it. But it's ther it's a serious lapse, a serious gap in a death penalty Jurisprudence,. We just don't know who we are sentencing to death, right?
