Truckee v. United States - What Do We Make of Silence?
Truckee argues that the Foreign Sovereign Immunities Act applies to criminal prosecution and provides kind of categorical sovereign immunity to foreign governments. It really hangs a tad on three main statutory arguments or statutory provisions in the FSIA. The real meat of the argument is on 28 US code 1604, which basically says we're going to give immunity to the jurisdiction of federal courts without distinguishing between civil and criminal matters.
