The Fear of More v. Harper Signals Something Big and More Versus Harper
The independent state legislature doctrine hung over the 2020 elections in a very ominous way like it could give the Supreme Court a way to decide a presidential election. I think there's gonna be just big blows for other, you know, LGBTQ rights and others. The same theory that the 14th amendment prevents any taking account of race is going to invalidate the Indian Child Welfare Act as well. Any day now we can see who on which Rick Hasen and I are jockeying to be more cynical and pessimistic in the face of a massive win for voting rights was a good day in America.
