The Constitution was written by a group of people who had won an eight-year war against the most powerful empire in the world. They knew that it was so weak and so unable to protect America from foreign enemies that something had to be done. In the case of people like Madison, they'd read probably every major work on rule of law for years before writing their own constitution. The founders were really extraordinarily sophisticated people who knew that they were standing at the crossroads of history if they could make it happen.
