Daniel Penny is charged with criminal negligent homicide manslaughter in a chokehold of Jordan Nealey. The homeless man who was dancing on the subway platforms has not just family, but to at least two family attorneys that are representing him. So what they're trying to say is that even though Daniel Penny did something that most people would say is objectively reasonable, he choked out a man. He didn't carry a weapon. He wasn't running around like holding on to a knife illegally and then stabbing some dude. He literally stepped into the gap where there was a problem.
