The Importance of Policies and Procedures in Preventing Harassment
The Supreme Court decision about reasonable care is a precedent that says to companies. If you have policies and procedures in place to prevent workplace harassment, a hostile work environment, sexual and racial discrimination, then they work in court as an affirmative defense against people trying to claim these conditions exist at the workplaces of question. And basically, they set the bar for proving and getting damages for harassment or a toxic work environment, much, much higher if you have these things on paper. These companies basically just know them with policies and procedural steps that they are performing in order to make the problem go away, rather than fix it in any meaningful way.
