The test is essentially an eyeball test, that it's something that you can determine without hiring those expensive lawyers or expensive site surveyors. Look at the river and then look at the water and does the wet land on your property if there is one flow directly into it. Is there literal physical touching? One can be aware of that and can see that for themselves. So what are the implications here beyond navigable waters? We've had a lot of regulatory agency cases in the recent terms of the US Supreme Court that have sort of hemmed in the ability of agencies to regulate.
