Rawls doesn't talk about the two clauses specifically, though I think it's quite clear he would endorse both non-establishment and free exercise. But when they conflict, how they're to be balanced, what we do with vexatious particular questions is a matter in which he's largely silent. He did very briefly address one question that came up in an American Supreme Court case some years ago,. The case involved an Amish family that wanted to pull their children out of high school.
