The Unconstitutional Biden Plan
Ezra Klein's objection is that if Biden did it, it would get litigated. But for Klein and Biden, the thing is that it would take too long and it would in Klein's argument, it would politically backfire because the Supreme Court would say it's unconstitutional. The rules have to count for your own side or they're not rules. The Constitution has to be for everybody or it's for nobody.
