There is a troubling conventional wisdom, I think coalescing in the legal academy right now. They certainly seem to be directing it at political elites. This would be taking power that is usually shared amongst three state branches of government. Two institutions that are coincidentally controlled by Republicans very disproportionately. It's weird to arguably the two least democratic institutions in American government.
