The theory is that brown versus board of education which was based on the 14th amendment equal protection clause means that we cannot consider race at all because doing so would be as i think you said in your intro reverse discrimination it's this concept of of color blindness. The original intent behind the reconstruction amendments of which the 14th is one and make it as plain as day are to reverse the effects of the enslavement of black people in this country.
